Terms of use

These terms apply to the use of ogameservers.com, operated by [Company name] (details in the imprint). By using the site you accept them.

1. The service

ogameservers.com is a top list for OGame private servers and OGame-like space strategy games. Players vote for servers; the list ranks servers by the counted votes of the current calendar month (UTC). Listing a server is free. We are not the operator of any listed server and are not affiliated with Gameforge 4D GmbH.

2. Voting

• Each visitor may vote for each server once every 12 hours. Votes from data centres, the Tor network and regions excluded by the server owner are not counted.
• Automated voting, buying or selling votes, vote exchanges and any other attempt to influence the ranking other than by genuine player votes are forbidden.
• We may void votes that we reasonably consider fraudulent. Voided votes do not count and are shown as voided on the server page.
• Rewards for voting are granted by the server owner, not by us. We do not guarantee that a server grants a reward.

3. Server owners

• You must be at least 18 years old, or have the consent of a legal guardian, to register an account.
• You may only list a server you operate, and you must prove control of its website with our verification tag. A server whose verification fails for 14 days is hidden until it passes again.
• Your texts, banners and screenshots must be accurate, must not infringe the rights of others (in particular trademarks and copyrights of Gameforge or other publishers), must not suggest an official affiliation with OGame and must not contain illegal, sexual, violent or hateful content.
• You grant us a free, non-exclusive licence to display this content on the site and in our promotion of the site for as long as the listing exists.
• You are responsible for handling vote callbacks correctly and for the personal data you receive through them (see our privacy policy).
• We may reject, hide or suspend a listing or an account, with a reason, if these terms are broken. Owners caught faking votes are warned, then their votes are voided, then their server is suspended.

4. Paid placements

Owners and advertisers can buy premium listings, featured slots and advertising banners for a fixed period.

• Never part of the ranking: paid placements never add votes and never change a server's rank. Every paid spot is labelled "Premium", "Sponsored" or "Ad".
• Orders and prices: prices are shown in euros in your account before you order[, including / plus VAT]. An order is binding once you confirm it. Slots are limited; an order is only accepted if the slot is free for the chosen dates.
• Payment: we send you an invoice with the payment details. The placement starts on the chosen start date once payment has been received. If payment has not arrived by the start date, we may cancel the order.
• Advertising content: ad banners are reviewed before they go live. We may refuse content that breaks these terms; in that case you can provide a new banner or receive a refund.
• Hidden or suspended servers: while a server is hidden or suspended, its paid spots are not shown. The remaining time is not extended automatically; if the reason was our error, we extend or refund it.
• Right of withdrawal for consumers: if you order as a consumer in the EU, you have a 14-day right of withdrawal. If you ask us to start the placement before the withdrawal period ends, you pay a proportionate amount for the days already provided, and the right of withdrawal ends once the placement has been fully provided. • Refunds: apart from the cases above, fees for a placement that has started are not refunded.

5. Availability

We aim to keep the site available at all times but do not guarantee uninterrupted operation. Maintenance, technical problems or events outside our control may interrupt the service.

6. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are only liable for breaches of essential obligations, limited to the damage typical and foreseeable for this kind of contract. We are not responsible for listed servers, their games, their rewards or their websites.

7. Changes to these terms

We may change these terms for valid reasons, such as new features or legal changes. Registered owners are informed by email at least 30 days in advance; if you do not object, the new terms apply.

8. Governing law

These terms are governed by the law of [country], excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection rules of their country of residence remain unaffected. If you are a merchant, the place of jurisdiction is [city].

9. Severability

If a provision of these terms is invalid, the remaining provisions stay in force.
